I certify that the answers which I have given to the foregoing questions and statements are true and complete to the best of my knowledge.

I understand that any misleading or incorrect statements or responses will render this application void and, if I am employed, will result in my immediate termination, regardless of the point in time at which the misleading or incorrect statement or response is discovered.

I authorize 4TOP HOSPITALITY GROUP, INC. ("The Company") to obtain from any person or organization with which or with whom I have been employed or associated, or who may otherwise have information concerning me, (whether listed by me in this application or not) any information they may have regarding my employment or educational history. I hereby release the Company and any and all such individuals, employers, educational entities, and corporations contacted from any and all liability for any damage flowing from the disclosure of this information or the Company’s action thereon.

I agree to submit myself, upon request by the Company, to a physical examination by a physician designated by the Company and to testing for the presence of alcohol and/or illegal drugs or other illegal substances by a physician or laboratory designated by the Company. I understand and agree that any positive test result or the refusal to submit to such testing or tampering with a test will result in my disqualification for employment with the Company. I acknowledge that the Company reserves the right to inspect all packages, cases, clothing, desks, and work spaces or any other item carried on or off the Company's premises, and I understand that cooperation with such inspections would be a condition of my continued employment with the Company.

I further acknowledge and understand that, if I am employed, the Company has the unilateral right, at any time and for any reason, to make changes in any or all employment policies, instructions, and procedures, and my job, with or without prior notice.

I further understand and agree my employment would not be for any specific term or period of time, and that the Company may take any action concerning my employment, including termination, with or without cause, with or without prior notice, and without further obligation to me, at the sole discretion and will of the Company. I also would be free to end my employment with the Company at any time for any reason I wish.

If hired, I also agree as a condition of my employment to sign the Company's Arbitration Agreement, which will require the Company and me to submit all disputes arising out of my employment to binding arbitration, to the extent such disputes cannot be resolved by informal means.

I understand that this application for employment will not be considered after 30 calendar days from the date below.

PLEDGE

In consideration of 4TOP HOSPITALITY GROUP, INC., further processing my application for employment, I agree that if I am hired, as a condition of my employment, I will sign, electronically or otherwise, a 4TOP HOSPITALITY GROUP, INC. ADR Agreement, which generally includes my agreement:

(1) to submit claims to mediation or arbitration in accordance with American Arbitration Association rules for the Resolution of Employment Disputes; (2) to waive my rights to a private lawsuit and to have that lawsuit heard by a judge or jury as to any claims that I may have now or have in the future against 4TOP HOSPITALITY GROUP, INC. or any of its subsidiaries; and (3) that any resolution of such claims will be final and binding on me and 4TOP HOSPITALITY GROUP, INC.. I further agree and understand that in order to obtain employment with 4TOP HOSPITALITY GROUP, INC. or its subsidiaries, I must sign the ADR Agreement upon hire.
